Please read this Agreement carefully as it governs your use of the Limerick Whiskey Experience website –
https://whiskeyexperience.ie - (the 'Site'). By continuing to use our site you are agreeing to the terms set out
below and are confirming that you are above the Irish legal age to purchase alcohol which currently
stands at 18 years of age. Persons under the legal age to purchase alcohol in Ireland are not permitted
purchase, receive or subscribe to any goods or services from this site.

Provision of Web Site Service

The Site is owned by Mother Macs LTD (VAT Reg. No. IE3367676OH) and operated by Limerick Whiskey

Limited Rights to Use Content

All material including any intellectual property in it displayed on the Site ("Content") belongs to Mother Macs
LTD or its suppliers. Mother Macs LTD gives you the right, for your own personal or non-commercial purposes
only to (1) retrieve and display the Content on your PC screen; (2) print individual pages on paper; (3) store
individual pages in electronic format. You may not store any Content on any server or other storage device
connected to an external network, or make any other use of the Content.

You may not, without prior written permission given by Mother Macs LTD within the previous six months, (1)
redistribute any of the Content or supply it to other people; (2) remove the copyright or trade mark notices from
any copies of Content made under this Agreement; (3) create a database in any form (including electronic or
structured manual form) by downloading, copying and storing all or any of the Content; (4) except as expressly
set in this Agreement, modify, reproduce or in any way use any of the Content.

Purchases

The prices for goods displayed for sale on the Site are as set out on the Site and are inclusive of VAT and Duty
at rates valid as of time of purchase. Where additional charges are made for delivery, they are clearly displayed.
By completing and submitting the electronic order form on the site you are making an offer to purchase goods
which, if accepted by us, will result in a binding contract.
By making that offer to purchase goods, you are also authorising Mother Macs LTD deduct the amount from
the card or payment method provided. We will confirm acceptance of your order by email, stating that the
goods ordered have been dispatched. This confirmation will be sent to the email address you provide on your
order details. Whether or not you receive an email, our acceptance of your order will create a legally binding
contract between us. We reserve the right not to supply you at our discretion. Where we are unable to fulfil part
or all of your order we will contact you and arrange to refund that amount to you.

Collection

Should Mother Macs LTD operate a collection service with the hours of operation clearly stated on our website
and selected at time of purchase.  While we endeavour to meet these collection hours from time to time it may
become necessary to alter the collection date.  Every reasonable effort shall be made to notify the customer of
any such change in advance.
 
Goods must be ordered by and received by a person 18 years of age or older. Where Mother Macs LTD or its
employees are in doubt as to the age of the person receiving the goods, they reserve the right to request proof of age and / or retain the goods until they can be received by a person of or above the legal age to purchase
alcohol.

Cancellation of Orders, Returns & Refunds

You can cancel your whiskey experience at any stage 72 hours prior to the designated time and a refund will be
issued less handling fee. Orders cancelled with less than 72 hours notice cannot be refunded. Simply contact us
by phone on +353 (0)61414900 or email [email protected]. To help us assist you as quickly as possible
please quote your order reference number.
You are entitled to a cooling-off period of 7 working days, which begins on the day after you place your order.
During the cooling-off period, you may cancel your order for any reason, once not within 72 hours of the
selected date. Upon cancellation, we will make the necessary arrangements to facilitate the return of the order
and will reimburse you within 30 days.

Data Protection and Cookie Policy

We are committed to protecting the personal data of anyone who uses our website. The information that you
provide about yourself to Limerick Whiskey Experience will only be used by us in accordance with our Data
Protection Policy as set out

Modifications to Website Content

In endeavouring to improve the Site and services offered, Mother Macs LTD reserve the right at all times to
make changes to the Content, including these Terms & Conditions. Prices and products are subject to change
without notification. You will be subject to the policies and Terms of Service in place at the time of your visit to
the Site.

General

There is no specific time limit applying to your access and use of the site. However, Mother Macs LTD reserve
the right to suspend or terminate your access and use at any time. It may exercise the right with or without
notice.

You may not assign, sub-licence or otherwise transfer this Agreement or your rights of access to the Site.

Failure by either party to exercise any right or remedy under this Agreement does not constitute a waiver of that
right or remedy Irish law will apply to this Agreement and both you and Mother Macs LTD agree to submit to
the non-exclusive jurisdiction of the Irish Courts. All contracts that result from the use of this website are
concluded in English.

Relevant legislation governing these Terms & Conditions is the Sales of Goods (Supply of Services) Act, 1980,
the Consumer Information Act, 1978, the Electronic Commerce Act, 2000, the EU Directive on Distance
Selling, SI 207 of 2001 and SI 68 of 2003, the Data Protection (Amendment) Act, 2003 and the Copyright &
Related Act, 2000.

TERMS AND CONDITIONS – Walking Tour

Booking Conditions:

All bookings are subject to the terms and conditions set out below. Your statutory rights are not affected. All tours and walks are operated by Mother Macs Limited, an Irish-registered Company T/A Limerick Whiskey Experience. Whether services are supplied or carried out directly by Mother Macs Ltd or through a third party, your contract is with Mother Macs Limited.

A booking is deemed to be made when a reservation is made by Mother Macs Limited “The Company” from an individual or group “The Customer”.

Clear understanding and acceptance of the following terms and conditions is implied when a booking is made and this constitutes the limit of The Company’s liability.

Modification or Cancellation of a walking tour by The Company


The Company endeavour to operate all our walking tours as advertised. However, we reserve the right to modify or cancel any tour up to 7 days before the start date of the tour.

The Company undertakes not to cancel or modify any tour within 7 days of the tour start date unless forced to do so by circumstances beyond its reasonable control.

In the event that we have to cancel a tour, the customer shall receive a full refund of the monies paid to us but will not be entitled to any further sum by way of compensation, damages or otherwise arising from said cancellation. This applies no matter when the tour is cancelled.

Our guided walking tours are dependent upon a minimum number of customers. Where the minimum number of customers has not been met 7 days prior to the start date, The Company is entitled to cancel the guided tour. Every effort will be made to find another tour that is convenient for you or, alternatively, all monies paid shall be refunded to the customer. However, The Company is not responsible for any additional expenses that may have been incurred by the customer in preparing the trip.

Force Majeure: 

Where war or terrorist activities, threatened or actual, civil unrest, industrial action, threatened or actual, weather conditions, fire, flood, drought, airport regulations or closures, unforeseen alterations to public transport schedules and rescheduling of air craft or any other event outside the control of The Company either delays or extends the tour or compels a change in prior arrangements, The Company cannot accept liability for any resulting loss, damage or expense to the customer.

Customer Cancellation or Modification
Modification: Where the customer wishes to modify the walking tour arrangements and The Company had accepted and confirmed the booking, a minimum administration fee of €5 (depending on which currency you used to pay your deposit) per booking will be applied.

If any additional costs have been incurred by The Company (e.g. administration, cancellation fees, etc.), these will also be charged to the customer. Any modifications will depend on alternative availability.
Modifications to tours that have been confirmed are not possible within 7 days of the tour start date.

Cancellations: Where the customer cancels the tour and The Company has accepted the booking the following charges shall apply:

  • A cancellation fee of 100% applies for cancellations made less than 48hrs in advance, or in case of no-show.
  • A cancellation fee of 50% applies for cancellations made less than 72hrs in advance.
  • No cancellation fee applies for cancellations made 3 or more days in advance.

If you cannot make the tour on the date requested and you contact us within 7 days of your tour date, then we may be able to provide an alternative date depending on availability.

Mother Macs Limited’s Liability to the Customer:

Although we take the greatest care to ensure that everything runs smoothly on your trip, accidents can happen. For this reason, Mother Macs LTD strongly encourages you to take out adequate insurance cover prior to travel for loss or damage to personal property, personal injury or illness, medical expenses and cancellation expenses. Please note that neither Mother Macs Limited or its employees nor its agents can accept any liability relating to personal injury or illness, loss or damage to personal equipment, or any other unforeseen events that occur during your tour.

  • You are strongly encouraged to obtain suitable medical insurance prior to travelling and booking a tour. While our tours are not adventurous in nature and do not require special physical preparation, all travel involves an element of risk.
  • You must take care of your own personal belongings. Mother Macs LTD will not be liable for any theft, damage, direct or consequential loss and inconvenience, however caused.
  • In relation to our tours that include food and drinks, it is your responsibility to notify the guide of any possible allergic reactions or religious-based aversion to food or beverages or other health concerns in advance.

Health, Fitness & Due Care

Walking is a physically strenuous outdoor activity and thus has an element of risk associated with it. The Customer understands and accepts that there is risk involved. The Customer is confident that they have a level of personal health and fitness sufficient to engage in such activity. Furthermore, the Customer confirms that they do not suffer (and have never suffered) from any per-existing medical condition which would preclude them from participating in such an activity.

The Customer will observe due care at all times and be mindful of their personal safety and that of the group. Furthermore, the Customer agrees to heed the advice and instructions of the guide in relation to matters of safety at all times.

Jurisdiction
This contract is made on the terms of these booking conditions which are governed by Irish Law and customers shall submit to the jurisdiction of the Irish Courts.

Tour information & Feedback
Our website (https://whiskeyexperience.ie) includes general descriptions of the various tours available, specifically outlining the itinerary and services included in the price. Changes in any or all of these items may need to be made
from time to time, and you should request a detailed dossier for up to date information about the tour.

Our website contains statements representing its honest belief that the facts as shown are correct. Every reasonable effort has been made to fully describe the tours offered and every reasonable attempt will be made to honour what has been described.

The Company reserves the right to make changes to the information, prices and itineraries set out in the website and provided such changes have been notified to the customer prior to the
submission of a booking form, such changes shall be binding on the parties.

Likeness: 

Any likeness of you secured or taken on any of our tours or any imagery/media which you capture and shared with us (e.g. either by email or on social media), may be used by The Company without charge in all media, for bona fide promotional or marketing purposes, including without limitation promotional materials of any kind, such as brochures or on the Internet.

Photo and video footage of you shot during the tour will not be used without your permission. If we want to use any of the photos or videos for marketing purposes or on our social media channels, the guide will notify you and ask you before taking such photos.

In the interests of continuing to offer the best possible standards of service, The Company reserves the right to share, or not to share, any feedback or comments received from you with our business partners.

No Smoking Policy

We do not permit smoking on any of our tours.
